Just as sellers' agents list homes for sale,
buyers' agents list their clients who are interested in purchasing a
home. Serious discussions about buying a house begin with an agent
spelling out buyer and seller representation rules. Before buyer
brokerage came about, people didn't always understand that the agent at
the real estate office was representing the seller's interests. Now
agents need to disclose it right away.
In our area, buyers and sellers must sign a
special form that expresses their relationship with an agent. Buyers
and their agents must enter into a formal, written agreement before they
are able to commence negotiations or offer bids on a property. And
while buyers may balk at the idea of signing yet another document, a
disclosure agreement is actually beneficial because it means that the
buyer has the Realtors exclusive loyalty. At the same time, the
agent is protected.
Sometimes the situation occurs in which
both the buyer and seller are represented by Realtors from the same
office. It is assumed that no conflict of interest will arise.
But, just in case situations occur, the office broker takes on the role of
disclosed dual agent. The role this individual plays is as a
mediator who listens and guides buy who cannot disclose any information
entrusted by one of the parties to the other. Not
